These Terms explain the rules for using BATETI websites, BATETI ID, reservations, purchases, products, software and connected services. Product-specific terms shown before payment or supplied with a product also form part of your agreement.
Scope, parties and acceptance
Your contract is with the BATETI legal entity identified in Legal Notice & Seller Details (“BATETI”, “we”, “us” or “our”). By creating a BATETI ID, submitting a reservation, placing an order or using a BATETI service, you agree to the parts of these Terms that apply to that activity and acknowledge our Privacy Policy.
You must be at least 18 and legally able to enter a binding agreement. If you act for a company, you confirm that you have authority to bind it. Consumer rights described in these Terms apply only when you act mainly outside your trade, business, craft or profession.
If product-specific terms conflict with these general Terms, the product-specific terms control for that product. Mandatory rights under applicable law always prevail.
BATETI ID and account security
You must provide accurate information and keep it current. You are responsible for protecting your password, authentication codes and recovery codes, and for activity carried out through your account until you notify us of suspected unauthorized use.
BATETI ID may link your account to products and device records held in Reflecta. Device ownership shown in an account is an administrative association and is not, by itself, proof of legal title. If a product is sold, returned or transferred, follow the supported ownership-transfer process so personal access and device data can be removed safely.
We may revoke sessions, require verification or temporarily restrict access when reasonably necessary to protect you, other users, a device or the service. Blocking a BATETI ID ends active BATETI web sessions and may also restrict connected Reflecta access according to the account integration.
Product reservations and “Coming soon”
A “Reserve”, “Join the list” or similar submission registers your interest only. Unless the page expressly states otherwise, it is free, no payment is taken, no stock is allocated and neither you nor BATETI is obliged to buy or sell.
A reservation does not guarantee launch date, territory, specification, certification, installation route or price. Before any payment becomes due, we will provide the final product description, seller identity, total price, delivery terms, withdrawal information and warranty terms. You may withdraw a free reservation at any time by contacting Support.
If BATETI later offers a paid deposit or pre-order, separate terms must be displayed and expressly accepted before payment, including whether the deposit is refundable and when a binding order is formed.
Orders, prices and payment
Products can be ordered only when marked available and checkout is enabled. Product pages and the bag are invitations to place an order, not acceptance of an order. You place an order when you confirm the order details, accept the current purchase terms and activate the PayPal control that clearly creates an obligation to pay. We accept the order when we send an order-acceptance or dispatch confirmation; an automated receipt only confirms that we received the request unless it expressly says the order is accepted.
Before payment, checkout will show the product and key characteristics, quantity, seller, total price and currency, included taxes, delivery charges, delivery restrictions, estimated timing, payment method and applicable withdrawal and warranty information. You must check these details and correct errors before paying.
Prices may change before an order is placed. A price change does not affect an accepted order. If an obvious pricing, availability or product-information error affects an order, we will contact you and may reject or cancel it before dispatch, with a full refund of any amount collected. We may reject an order for unavailable stock, unsupported delivery location, suspected fraud, failed payment or legal restrictions.
PayPal processes payment under its own terms. BATETI receives the status and identifiers needed to reconcile the order but not your full payment credentials. You must use a payment method you are authorized to use.
Delivery, installation, returns and warranty
We currently support only the countries offered at checkout. The delivery method, cost and estimate shown in the order summary apply to that order. Dates are estimates unless expressly guaranteed. If delivery is materially delayed, we will provide the remedies required by applicable law.
Risk of loss passes when you or a person you nominate receives the product, unless mandatory law provides otherwise. Ownership passes only after full payment. You are responsible for accurate delivery details, safe access and any site conditions disclosed as your responsibility. Installation must follow the supplied instructions and any electrical, wall, moisture or placement requirements.
Our Shipping & Delivery Policy, Returns & Refunds Policy and Warranty & Legal Rights provide the current process. They do not reduce non-excludable rights for late delivery, defective goods or lack of conformity.
Products, software, updates and connected services
Images are illustrative. Natural materials, reflections, screen appearance and finishes may vary within reasonable manufacturing tolerances. Final dimensions, ratings, compatibility, installation conditions and included accessories are those confirmed for your order. Marketing concepts and planned features are not safety certifications or a promise that an unreleased feature will ship.
Some features require power, Wi‑Fi, internet access, BATETI ID, Reflecta services, compatible third-party services or current software. Availability may vary by model, country, language and software version. We may provide security, reliability and feature updates. Do not interrupt an update or use unsupported modifications that could make the product unsafe.
BATETI grants you a limited, personal, non-exclusive, non-transferable and revocable license to use BATETI software supplied with a product or service for its intended purpose. Software is licensed, not sold. Open-source components remain subject to their applicable licenses. You may not copy, distribute, sell, lease, bypass security or reverse engineer software except where applicable law expressly permits it.
Third-party content and services are provided under the third party’s terms. We are not responsible for a third party’s independent service, but this does not affect responsibility we cannot exclude for the BATETI product itself.
Acceptable use
You may not use BATETI services to:
- violate law, another person’s privacy or intellectual-property rights;
- gain unauthorized access to an account, device, network, API, administrator area or data;
- introduce malicious code, interfere with security or availability, or overload the service;
- scrape or use automated access except through an authorized interface and within its documented limits;
- impersonate another person, submit false information or use a payment method without permission;
- use a product in a way that contradicts safety, installation or maintenance instructions.
You remain responsible for information and instructions you submit and for obtaining any permission needed to connect third-party accounts or data.
Intellectual property and feedback
BATETI names, logos, product designs, interfaces, software, documentation, photography and website content are owned by BATETI or its licensors and protected by applicable law. No ownership right is transferred except ownership of the physical product after full payment.
You retain rights in content you submit. You give BATETI only the limited permission needed to store, process, transmit and display it to provide the service you requested. If you voluntarily send product feedback, you allow us to use it without restriction or payment, provided we do not publicly identify you without permission.
Service availability and liability
We provide services with reasonable care and skill. Connected features may occasionally be unavailable for maintenance, updates, security incidents, internet failure or circumstances outside reasonable control. We will use reasonable efforts to restore them and, where appropriate, give notice.
Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, deliberate misconduct, breach of mandatory product or consumer law, or any liability that cannot legally be limited. Nothing excludes a statutory remedy for defective or non-conforming goods.
To the maximum extent permitted by law, BATETI is not liable for indirect or consequential loss that was not reasonably foreseeable when the contract was formed, or for business loss suffered by a consumer. For business users, any separate written business agreement controls liability for the project.
You are responsible for backing up information you choose to connect to a service before repair, reset, return or ownership transfer. We are not liable for loss caused solely by failure to follow clear safety, compatibility, update or backup instructions.
Suspension, changes, governing law and disputes
Suspension and termination
You may stop using the services and request account closure. We may restrict or terminate access for a serious or repeated breach, legal requirement, fraud or security risk. Where reasonable, we will give notice and an opportunity to remedy the issue. Terms that must logically survive—such as payment, ownership, liability and dispute provisions—continue after termination.
Changes to these Terms
The version accepted for an order continues to govern that order. We may update terms for future use or ongoing services. If a material change affects an ongoing paid service, we will provide reasonable advance notice and any cancellation right required by law.
Governing law and disputes
These Terms and non-contractual disputes are governed by the law of the country where the selling BATETI entity is established, as identified in Seller Details. This choice does not deprive a consumer of mandatory protections available under the law of their habitual residence. Courts with jurisdiction under applicable law may hear a dispute.
Please contact BATETI Support first so we can try to resolve the issue. Consumers in Georgia may also apply to the Georgian Competition and Consumer Agency or a competent court where the legal requirements are met.
General
If a provision is unenforceable, the remaining provisions continue. A delay in enforcing a right is not a waiver. You may not transfer your agreement without our consent, except where law permits. We may transfer it as part of a reorganization or sale that does not reduce your mandatory rights.
